
How to terminate the contract?
The maid who has been working does not want to continue the contract due to unexpected reasons or personal reasons, or the employer is dissatisfied with the maid and wants to terminate the contract. What should they do?
Here we will discuss solutions under different situations.
1, The maid herself want to terminate the contract
In this case, the employer can communicate with the maid first.
If it is due to some misfortune in the family, the employer needs to ask the maid ’s intentions whether it is ready to go back and deal with it. Since the person has passed away, the siblings in the family can contribute. When they go back, they can only provide physical help. Financial support may alleviate the pressure of siblings even more.
1)If the maid chooses not to go back, but needs to borrow hundreds or even thousands of SGD from the employer and send it back for relief.

In this case, because each family is different, the amount the employer can afford is different. The employer can consider the maid ’s usual performance, loan repayment ability, and the amount of loan the employer can accept.
2)If the maid chooses to go back to work and return to work as soon as possible.
the employer must help the maid to buy the outbound ticket and settle the salary.
3)If the maid does not choose to return.
this situation is the final contract to be negotiated. Whether the employer and the maid choose to terminate the contract in one or two directions, the process of termination should begin.
Specific process of termination:
If both parties confirm to terminate the employment contract, it is ok to follow the normal procedures.
- cancel the work permit.
- terminate the maid insurance contract.
- buy air ticket and settle her salary.
- check the luggage and send her to the airport.
If the maid still has loan, pls always remember to ask help from employment agency instead of sending her back directly.
2, The employer want to terminate the contract
In this case, pls also discuss with your maid first, see if both of you can accept
1) Terminate the contract by transferring her to another employer in Singapore
If your maid still want to work in Singapore and don't want to go back, you can send her back to employment agency for transfer. In this case, you do not need to pay for her air tickets. But before she been transferred to the other employer, you are still in responsible for her and need to pay for her lodging if she stay with employment agency instead of staying at your home. And you need to pay for the levy as long as the maid been transferred out.
Remember to sign LETTER OF CONSENT so that your maid can proceed with looking for another employer.
2) Sending her back to her home country
If your maid want to go back home to take a break, or the employer want to send her back to home country instead of letting her transfer.
In this case, pls follow the below procedure
- cancel the work permit.
- terminate the maid insurance contract.
- buy air ticket and settle her salary.
- check the luggage and send her to the airport.
If the maid still has loan, pls always remember to ask help from employment agency instead of sending her back directly.
